В статье сделан анализ роли суда в процессе доказывания в административном судопроизводстве. Обосновано, что административном судопроизводстве различие правового статуса сторон требует более активного участия суда, чем в гражданском и арбитражном процессах. Доказано, что суд является субъектом собирания доказательств в административном процессе. Предложены изменения отдельных положений административно-процессуального законодательства, укрепляющие активную роль суда в процессе доказывания.

This article analyzes the role of the court in the evidentiary process within administrative proceedings. It is argued that the disparity in the legal status of the parties in administrative proceedings necessitates a more active role for the court compared to civil or commercial (arbitration) litigation. The article establishes that the court functions as an active participant in the collection of evidence within the administrative process. Furthermore, it proposes amendments to specific provisions of administrative procedural legislation designed to strengthen the court’s active role in the evidentiary process.
