В статье рассматривается исследования в сфере родительских правоотношений, положенных в основу формирования современной теории. Автором показаны ключевые выводы российских ученых. Обосновывается, что современная теория родительских правоотношений в настоящее время не сформулирована, что дает основание для вывода о необходимости ее создания и разработки. Автор полагает, что развитие научно-технического прогресса стало серьезным вызовом для науки семейного права, главным образом, произошла значительная корректировка понятия «родительство», выступающего в качестве отправной точки для возникновения родительского правоотношения. Делаются выводы об отсутствии единства в суждениях и выводах отдельных авторов, единой сквозной линии, позволяющей представить полное представление о родительском правоотношении.

The article examines research in the field of parental legal relationships that has formed the basis for the development of modern theory. The author presents the key conclusions of Russian scholars. It is substantiated that the modern theory of parental legal relationships has not yet been formulated, which gives grounds for the conclusion that it is necessary to establish and develop it. The author believes that the advancement of scientific and technological progress has become a serious challenge for the science of family law, primarily resulting in a significant adjustment of the concept of «parenthood», which serves as the starting point for the emergence of parental legal relationships. Conclusions are drawn regarding the lack of unity in the judgments and conclusions of individual authors, as well as the absence of a coherent overarching framework that would provide a comprehensive understanding of parental legal relationships.
