В статье рассматривается проблема правового регулирования статуса эмбриона человека In vitro, созданного в процессе применения вспомогательных репродуктивных технологий (ВРТ), а также вопросы его защиты в международном и национальном праве зарубежных стран. Исследуются подходы к определению правового статуса эмбриона в правовых системах Швейцарии, Германии, Италии, США, Китая и других государств, а также в рамках международных договоров (Декларация прав ребенка 1959 г., Пакт о гражданских и политических правах 1966 г., Американская конвенция о правах человека 1969 г.) и решений международных судебных органов.

The article examines the problem of legal regulation of the status of the human embryo in vitro, created through the use of assisted reproductive technologies (ART), as well as issues of its protection in international and national law of foreign countries. Approaches to determining the legal status of the embryo are studied in the legal systems of Switzerland, Germany, Italy, the USA, China and other states, as well as within the framework of international treaties (the Declaration of the Rights of the Child of 1959, the International Covenant on Civil and Political Rights of 1966, the American Convention on Human Rights of 1969) and decisions of international judicial bodies.
